1. Who we are
HeyMotion is provided by Growth Marketing S.r.l., Via Ponte di Tappia 47, 80133 Napoli (NA), Italy, P.IVA 09899971213, PEC growthmarketing@pec.it, email [contact@your-domain].
2. Who can use HeyMotion
You must be at least 18 years old. If you sign up for a company, you confirm you are authorised to accept these terms on its behalf. A consumer is a person acting for purposes outside their trade, business or profession; consumers keep every right that the law gives them, and nothing in these terms limits those rights.
3. The service
HeyMotion turns videos into short clips, voiced tutorials, written guides, translated versions and cleaned-up audio using AI. Results are generated automatically and can contain mistakes—in transcripts, translations, voices or cuts. Review them before you publish.
4. Your account
Keep your sign-in details safe and tell us at once if you think someone else is using your account. You are responsible for what happens in your account.
5. Plans, prices and minutes
- Plans, prices and monthly minutes are shown on the pricing page before you buy. Prices include VAT.
- Clipping, dubbing and audio cleanup use 1 minute per minute of uploaded video. Voiced tutorials use 4 minutes per minute of finished tutorial. Re-running clips on a video you already processed uses 0.25 minutes per minute.
- Minutes renew at the start of each billing period. Unused minutes do not carry over.
- If a job fails or you cancel it, the minutes it was holding are returned to your balance.
- Paid plans are subscriptions: they renew automatically at the end of each monthly or annual period, at the price shown when you subscribed, until you cancel.
6. Cancelling your subscription
You can cancel at any time on your own, in the Stripe billing portal you open from your account’s billing settings. Cancellation stops the next renewal: your plan stays active until the end of the period you have already paid for, and your account then returns to the Free plan. Apart from the right of withdrawal below and the other cases where the law requires one, payments are not refunded, including for unused minutes or part of a period.
7. Right of withdrawal (consumers only)
If you are a consumer, you can withdraw from a paid subscription within 14 days of buying it, without giving any reason (Articles 52 and following of the Italian Consumer Code, Legislative Decree 206/2005).
- How: withdraw on your own in the Stripe billing portal you open from your account’s billing settings, or send us a clear statement—for example with the model form below—by email to [contact@your-domain] or by PEC to growthmarketing@pec.it. Sending it before the 14 days end is enough.
- Refund: we refund what you paid within 14 days of receiving your withdrawal, with the same payment method, at no cost to you.
- If you started using the service during the 14 days: when you subscribe you can ask us to start the service straight away. If you then withdraw, you pay only for the service provided up to the moment you told us, in proportion to the whole subscription; we refund the rest.
Model withdrawal form (fill in and send only if you want to withdraw): “To Growth Marketing S.r.l., Via Ponte di Tappia 47, 80133 Napoli (NA), Italy, growthmarketing@pec.it: I hereby give notice that I withdraw from my contract for the provision of the following service: HeyMotion subscription — Ordered on: … — Name: … — Account email: … — Date: … (Signature, only if this form is sent on paper).”
8. Legal guarantee (consumers)
As a consumer you are entitled to the legal guarantee of conformity for digital services under the Italian Consumer Code. If the service does not work as described, tell us and we will bring it into conformity; your statutory remedies are not affected by these terms.
9. Your content
- You keep all rights to the videos you upload and to the results you create with HeyMotion. You give us only the permission we need to store and process them to provide the service to you, and it ends when you delete them.
- You must have the rights and permissions needed for what you upload—including the consent of people who appear or speak in your videos.
- We do not use your content to train AI models, and we do not publish it unless you ask us to.
10. AI-generated content and acceptable use
HeyMotion creates synthetic voices, translations and edited video. When you publish content that could make people believe something real happened or was said—for example a realistic voice of a real person—you must disclose that it was generated or altered with AI, as required by the EU AI Act (Article 50) and other applicable law. You must not use HeyMotion to:
- upload or create illegal content, or content that infringes someone else’s rights;
- impersonate a real person or make them appear to say or do things without their consent;
- deceive or defraud people, or spread spam or malware;
- try to break, overload, reverse engineer or get around the limits of the service.
11. Reporting illegal content
If you believe content stored on HeyMotion is illegal, write to [contact@your-domain]. Tell us why you think it is illegal, where it is (for example the link or job you were given), your name and email, and confirm that your report is accurate and made in good faith. We review reports diligently and tell the reporter and the user concerned what we decided and why. The same address is our point of contact for users and for authorities under the EU Digital Services Act; we communicate in English and Italian.
12. Suspension and termination
We may suspend or close an account that breaks these terms or the law, after telling you why—immediately where the breach is serious or we are required to act. If you are a consumer and we close your paid account without fault on your side, we refund the unused part of the period.
13. Changes to the service and to these terms
We improve HeyMotion continuously and may change features. We will tell you by email at least 30 days before a change to these terms that affects you; if you do not agree, you can cancel before it takes effect.
14. Liability
We are not liable for indirect losses or for how you use the results you publish. Nothing in these terms limits our liability for wilful misconduct or gross negligence, or where the law does not allow it (Article 1229 of the Italian Civil Code), nor any right consumers have under the law. For business customers, our total liability is limited to the fees paid in the 12 months before the event.
15. Law, courts and complaints
These terms are governed by Italian law. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live, and disputes go to the court of your place of residence. For business customers, the Court of Naples has exclusive jurisdiction.
For any complaint, write to [contact@your-domain]. If we cannot solve it, we will tell you which alternative dispute resolution body is competent and whether we will take part.
